Ministerial decisions under the Heritage Act 2011.

The Heritage Act 2011 provides the Minister with the following decision-making responsibilities:

  1. Decision on a major work application to a Heritage Place or Heritage Object (sections 73(3) and 77)
  2. Decision to provisionally declare a place or object to be a Heritage Place or Heritage Object because it is likely significant and at risk (section 36).
  3. Declaration of a place or object to be a heritage place or object before the Council invites public submissions on a proposal. The Minister has no discretion on this provisional declaration (section 37).
  4. Decision on the permanent declaration of a place or object to be a Heritage Place or Heritage Object (sections 34, 35, 40).
  5. Decision on the permanent declaration of a class of place to be a protected class of place (sections 50,51).
  6. Decision on the revocation of a heritage declaration (section 65).

Decisions made on major work applications are reported as Major Work Notices.

All other decisions listed above are published in the Northern Territory Government Gazette at the time of the decision. The gazettal date and the signed ministerial instrument can be viewed on the Northern Territory Heritage Register. The status of each place and object nominated to the Heritage Register can be viewed on the Northern Territory Heritage Register.
