Major Works Notices
It is an offence under the Heritage Act 2011 to knowingly or unknowingly engage in conduct that results in damage to a heritage place or object unless it is in accordance with a heritage agreement, a work approval, an authorisation under the declaration or a repair order.
An application for a work approval can be made under section 72 of the Heritage Act 2011. If the application is for carrying out major work the Minister is the decision maker. Section 75 of the Heritage Act 2011specifies the matters the Minister must consider in making their decision. This includes advice from the Heritage Council.
Major work is defined as work that is likely to cause significant damage to a heritage place or object or significantly alter the heritage significance of a heritage place or object.
